Indian Army Chief General Bipin Rawat on Thursday said that the most recent year's Supreme Court (SC) decision on decriminalization of gay sex would not be actualized in the Army as the power seemed to be "very conservative." 

"Homosexuality was decriminalized by the Supreme Court a year ago, yet 'hum logon ke yahan nahi chalega' (this would not work here). 

"In the Army, these things are not worthy. We won't enable this to occur at all in the power," he told media at Army's yearly question and answer session in New Delhi. 

Conceding that the Army was not exempt from the laws that apply to everyone else, General Rawat said the Constitution still gave it some freedom. 

"The Army is exceptionally traditionalist. We can't enable homosexuality to execute into the Army. We are neither modernized, nor westernized," he said. 

General Rawat said the LGBT (lesbian, gay, swinger, transgender) issues were not worthy to the military and offenses identified with homosexuality would be managed under the Army Act. 

"We would in any case manage the issues under the Army Act," he cleared up. 

As per Section 46 (an) of the Army Act, 1950, any individual blameworthy of any despicable direct of a barbarous, foul or unnatural kind will, on conviction by court-military, faces up to seven years in prison. 

 

Till last September, Section 377 of the Indian Penal Code (IPC) was utilized to condemn sexual exercises "against the request of nature".
