Know More About End-Of-Service Benefits

Every now and then we hear about our friends or relatives who feel like they didn’t receive their rightful end-of-service benefits from their employers. It’s very important to make sure that you always receive your full compensation at the end of your services as this amount can be helpful in retirement plans or if you’re looking to invest the money.

You have every right to stake claim to unpaid salaries or even to annual leave salary. Always remember that you can claim for unpaid compensation within one year from the time that this compensation is due to you. You can also claim the amount due if you’ve changed your employer.

 

Article 126 of the Federal Law No. 8 of 1980 regulating Employment Relations in the UAE states, in case an individual switches his job or his occupation, the contract signed by the employee when he left for the new job shall continue between the new employer and the employee. The previous employer and the new employer will share liability for a period of six months to make sure that all the previous amount due to the employee is settled if he’s eligible to any compensation once he’s hired by the new employer. Once this six-month time frame expires, the new employer will be solely liable for all compensations to be paid to the employee.

According to this law, your employer is liable to pay all your end-of-service benefits to you and is also liable to pay for your air ticket. An employee can claim for a return air ticket from his employer once is two years, this is in line with the provisions sanctioned under Article 131 of the Employment Law.

Another law which has been made for employee protection is Article 6 of the Employment Law. It states that the employee has to stake a claim for any unpaid dues within one year from the time when this amount was to be paid to him failing which the claim will be refused in Court. This provision is not applicable to end-of-service benefits.
