Dubai worker accused of molesting sleeping Filipina cleared of charge

A worker charged at the Dubai Court of First Instance with molesting a sleeping Filipina after he allegedly sneaked into a women's room, was cleared of a sexual harassment charge on Wednesday.

Prosecutors accused the 26-year-old Pakistani man of trespassing, molestation and consuming alcohol without a licence.

 

He had consumed three cans of alcohol prior to the incident.

The court did not find him guilty of a molestation charge and referred him to the Court of Misdemeanors on the charges of trespassing and consuming alcohol without a licence.

A complaint was filed on August 28 at Al Qusais Police Station.

The 26-year-old complainant, a waitress, said she was sleeping about half past midnight in her room, which is shared by five other women at their company's staff accommodation.

"I felt someone pulling the pillow off my head and then fondling me. I opened my eyes and saw it was a man - the one on trial."

When he noticed she woke up, the man rushed out.

"I woke up my roommates and then we checked the recordings of the cameras installed in the hallway near the room and identified the suspect," the complainant told the prosecutor, adding that the intruder was also caught on camera turning the kitchen's light off so his face would not show in the dark.

A policeman said they went to the building after 1:30am and were told by the victim that she had forgotten the room's door open, following which the suspect sneaked inside.

"He was brought to us by the security guard. He smelled like he had been drinking liquor. He claimed he entered the woman's room by mistake as the lights were off. He admitted he have had alcohol," the officer told the investigator.

The worker is in detention.

The court ruling may be appealed by the public prosecution.
