End-of-service benefits rejig only for Kuwaitis

In view of the concern that the expatriates are the biggest beneficiaries of the amendments to the labor law in the private sector, and that the law will put a burden on the employers, the Rapporteur of the Health Committee of the National Assembly MP Osama Al-Shaheen said the amendment of calculating the end of service benefits is limited to Kuwaitis only to encourage them to join the private sector and various other businesses, reports Al-Rai daily.

Al-Shaheen stressed that “It is not retroactive” and that before the bill goes for the second reading during the next meeting of the National Assembly, the legislative wording has been amended to prevent confusion in this aspect.”

 

The sources added that the current law does not distinguish between the Kuwaiti worker and the expatriate worker, and there is flexibility in dealing with the amendments made in the first deliberation.” The sources stressed on the possibility of keeping the annual leave to 30 days and days off and holidays to be added.

As for retroactivity, Al-Shaheen said there is no worry about it because it is about Kuwaiti workers, because the expatriate worker does not get retirement benefits but is given only end of service for his years of work. The Kuwaitis are the ones who get the end of service benefits before they retire.”
